The Court of Appeal sitting in Benin, the Edo State Capital, on Friday dismissed a case filled by Senator Ovie Omo-Agege seeking a leave of court to appeal the Federal High Court Judgement which sacked the Prophet Jones Erue-led faction of the Delta State chapter of the All Progressives Congress (APC).

Also dismissed is a case filled by the House of Representatives-elect, Rev Francis Ejiroghene Waive.

A Federal High Court, in Asaba, Delta State had in a judgment delivered by Justice Toyin Adegoke, upheld the faction of Olorogun O’tega Emerhor, led by Chief Cyril Ogodo as the authentic chairman of the party in the state.

The court sacked the Erue-led faction of Delta APC which produced Senator Omo-Agege and Waive as candidate of the party in the 2019 general elections.

The Appeal Court in its ruling on Friday dismissed both applications for lacking in merit and thus fined them N300,000.
